Biography

Arden maintains a broad commercial and public law litigation practice, and has appeared as lead counsel before all levels of court in British Columbia, Ontario, and Alberta, as well as at the Federal Court and various administrative tribunals.

Arden’s commercial litigation practice is bolstered by his strong financial and business acumen. Before law school, Arden began his professional career as an investment banker in New York, giving him a deep understanding of corporate finance. After law school, he clerked for judges on the Commercial List at the Ontario Superior Court of Justice in Toronto, and then practiced for many years at leading commercial and administrative law litigation firms in Toronto and Vancouver, before establishing Beddoes Litigation.

Arden has also acted as counsel in a range of significant public law matters which have shaped precedent in the areas of government liability and constitutional rights. He has acted for and against government entities, represented clients before a number of administrative tribunals, and has acted for applicants and interveners in cases concerning the Charter of Rights and Freedoms.

As an active participant in the legal profession, Arden has presented on a range of issues at law schools and continuing legal education seminars. His commentary has also appeared in a variety of legal and mainstream publications.

Arden is frequently recognized by industry publications based on client and peer reviews, with interviewees commenting that he is “very bright” and an “effective courtroom advocate” who is “extremely knowledgeable about the law”. He is listed by Lexpert as “repeatedly recommended” for corporate and commercial litigation, and was previously recognized as a “leading lawyer to watch”. He is listed by Benchmark Litigation as a Litigation Star in commercial and public law, and he appeared in the same publication’s “40 & Under Hot List” in 2021 through 2023. In 2024, he was recognized as an Emerging Talent Litigator of the Year at the Benchmark Litigation Canada Awards. Arden has also been recognized since 2023 by The Best Lawyers in Canada™ as a leading lawyer for corporate and commercial litigation.

Notable Cases

Animal Justice et al v. A.G. of Ontario, 2024 ONSC 1753

Arden Beddoes acted for two of the applicants in successfully striking key provisions of the Security from Trespass and Protecting Food Safety Act, 2020, which operated to effectively stop all undercover investigations into factory farms in Ontario. The Court struck the key provisions for violating the right to free expression under section 2(b) of the Charter of Rights and Freedoms, which the Court determined could not be saved under section 1 of the Charter. The successful applicants were Animal Justice, and two individuals. Arden Beddoes represented the two individuals, while Animal Justice was represented by lawyers from Stockwoods LLP. Port Alberni Shelter Society et al v. Graham Hughes et al., 2021 BCSC 1754

Arden Beddoes and Justin Wiebe acted for the plaintiffs in an action for defamation related to a prolonged defamatory campaign waged over social media. The plaintiffs were awarded damages of more than $340,000, and the court issued permanent and mandatory injunctions requiring the defendants to stop making the defamatory statements, and to remove existing statements from the internet. In explaining the award, the court said that the nature of the defendants' campaign was "so wrong and so prolonged and so extreme that the court must express condemnation of it". Manning v. Dhalla, 2019 BCSC 1067

Ken McEwan, K.C. was recently successful in having the British Columbia Supreme Court grant a rare mistrial order, in a judge-alone trial and following reasons for judgment had initially been issued: Manning v. Dhalla, 2019 BCSC 1067. In the underlying litigation, the plaintiffs claimed that the defendant referred them to a Ponzi scheme while concealing the fact that he was receiving commissions from the orchestrator of the scheme – Rashida Samji – for doing so. At trial, the defendant denied receiving any commissions, while Ms. Samji testified that she did pay him commissions, but could not recall precise details. In the absence of documentary support for the claim, the court preferred the defendant’s testimony. On the basis of document which came to light after the reasons were issued, the court concluded that “the plaintiffs appear to have found a ‘smoking gun’. The only way to avoid a miscarriage of justice is through a new trial with the evidentiary gun in evidence.” Ken was retained to argue the mistrial application, with Arden Beddoes (then of Arvay Finlay LLP).
