With real estate sales and development at record levels, disputes inevitably arise, be it in the context of property sales, leases or land development issues.

Our lawyers have acted in a diverse range of real estate and property matters. We routinely work with transactional lawyers to provide advice in the context of a collapsing deal or emerging dispute. We recognize the importance of timely, yet considered, advice to preserve a claim or position a defence.

Our lawyers have succeeded in a number of real property disputes in a wide range of areas concerning residential, commercial and industrial properties. In particular, we have acted in cases involving the purchase and sale of land and deposit claims, leases and rent renegotiations, strata disputes and wind-ups, and land development. We have also acted in easement and right of way disputes, as well as for clients in land assessment and taxation matters. An example of successful representation of clients in this area is Cox v. Seymour Village Management Inc., 2015 BCSC 275.

We realize that with real estate litigation, effective representation requires both an appreciation of the deal and the complex legal landscape that informs a party’s rights and obligations. We have the insight and experience to represent clients, and provide advice to solicitors working with them, in any real estate or property law dispute.
