Biography

David Gruber maintains a broad litigation practice with a focus on corporate and commercial disputes, arbitration, restructuring and insolvency, and class actions. He has appeared regularly before the superior and appellate courts of British Columbia and Ontario, as well as the Federal Court, and has acted in several reported cases. In addition to his litigation experience, David has significant expertise in international and domestic arbitration, alternative dispute resolution, and complex dispute settlements. He also serves as an arbitrator and has rendered several awards in domestic arbitration matters.

David’s corporate and commercial litigation experience includes shareholder and partnership disputes, breach of contract claims, securities matters, and allegations of breach of fiduciary duty. He has regularly acted on fraud and asset recovery matters, with extensive experience obtaining and defending Norwich orders, Mareva injunctions, Anton Piller orders, and other extraordinary remedies. His clients include corporations of all sizes, professional firms, governments, public and quasi-public institutions, and private individuals.

In the area of restructuring and insolvency, David has represented acquirors, monitors, trustees, receivers, creditors, and other stakeholders in large-scale Companies’ Creditors Arrangement Act and Bankruptcy and Insolvency Act matters. He is a member of the Insolvency Institute of Canada, the country’s premier private sector insolvency organization, whose membership is drawn from the most senior and experienced professionals in the field.

David obtained his law degree from the University of Victoria and later earned an LL.M. from the University of Cambridge. He was awarded a diploma in International Commercial Arbitration in 2010 and is a Fellow of the Chartered Institute of Arbitrators.

David is ranked in Chambers Canada (Band 3) for Litigation: General Commercial (B.C.) and is recognized in The Legal 500 Canada for Dispute Resolution. He is listed in the Lexpert Special Edition—Canada’s Leading Restructuring and Insolvency Lawyers and is ranked as “Consistently Recommended” in the Canadian Legal Lexpert Directory for Insolvency and Restructuring.

In addition to his practice, David is actively involved in leadership roles within the legal and broader community. He is the Chair of the Board of Directors of the Vancouver Hospice Society and serves on the Boards of Directors of the Vancouver International Arbitration Centre and the Western Canada Commercial Arbitration Society.

Prior to joining McEwan Partners, David was the national co-head of litigation at a national law firm.
