Ken McEwan, K.C. and Laésha Smith successful for Law Society of British Columbia in defending against petition seeking to stay investigation.

In A Lawyer v the Law Society of British Columbia, 2021 BCSC 914, the court dismissed the lawyer’s petition for judicial review seeking to stay an investigation of his practice. The lawyer argued Charter grounds (section 8), sought administrative law remedies, and attacked the basis of the order as overbroad. In comprehensive reasons emphasizing the public interest mandate of the Law Society, and the nature of its investigatory functions, the court dismissed all arguments of the petitioner.
