Jason Robert is Co-Counsel in Landmark Class Proceeding Aimed at Protecting Children’s Rights in Custody

Jason Roberts is serving as co-counsel alongside a lawyers from Koskie Minsky LLP in a class action impacting Canadian youth in custody.

The proceeding, filed in Manitoba, has garnered significant national attention. It challenges the segregation of children in custody, arguing that placing incarcerated youth in prolonged isolation violates their rights and causes serious and lasting harm. This case is one of the first Canadian class actions to put the systemic mistreatment of incarcerated youth under judicial scrutiny, highlighting the urgency and importance of the issue.

The matter is scheduled for trial this November and will be closely watched, not just for its outcome, but for the questions it forces Canadians to confront:

  • What safeguards must exist to protect the rights of children in custody?
  • How should governments be held accountable when those rights are breached?
  • And what lessons will this case set for the future of youth justice in Canada?

As co-counsel, Jason Roberts is honoured to play a role in advancing this critical conversation before the courts.
