Emily Kirkpatrick and Evan Cribb successfully defended Simon Fraser University on an injunction application brought by a group of Red Leafs football players against the University.

Justice Stephens dismissed the injunction application, finding that the applicants had failed to establish a strong prima facie case that there was a contract that required the University to continue its football program as alleged in their underlying claim and that the balance of convenience favoured denying the injunction. Justice Stephens also concluded that the orders sought by the applicants were inappropriate as excessively vague and requiring ongoing judicial supervision.
