This was an application by an executor to validate a gift granted to him under a will following the filing of conflicting affidavit evidence regarding his witnessing of the Deceased’s signature. Gomez was counsel to the respondents/beneficiaries. The respondents, were successful in seeking special costs against the executor, personally, for both the respondents and estate.
