Ken McEwan, K.C., Saheli Sodhi, and Alex Kim, on behalf of one of the respondents, successfully defended against allegations advanced by the applicant company that the respondents were acting jointly and in concert and breached their disclosure obligations under the Securities Act, R.S.B.C. 1996, c. 418.
In this case, the applicant company sought both cease trade and cease vote orders before the BC Securities Commission, in addition to orders requiring the respondents to provide curative disclosure. On September 14, 2023, the Commission panel dismissed the application. The panel’s written reasons have not yet been issued, but the ruling can be found here.
