Capping off the semester at the Peter A. Allard School of Law at the University of British Columbia, Emily Kirkpatrick delivered a guest lecture in Advanced Contract Law. Over Zoom, Emily presented an interactive case study of Owners, Strata Plan LMS 3905 v. Crystal Square Parking Corp., 2020 SCC 29, a case which Ken McEwan, K.C. and Emily successfully argued at the Supreme Court of Canada. The case was chosen for study as the Supreme Court of Canada clarified and confirmed the law of pre-incorporation contracts, as well as the law in respect of contract formation, more generally. The Court also addressed the interplay between the Strata Property Act and contract law, and between contract law and real covenants, respectively.
