Arden Beddoes, Justin Wiebe, and Sydney Gomez (together with David Wu of Arvay Finlay, LLP) acted for the plaintiff in an action for misfeasance in public office concerning the denial of the required permits for a run-of-river hydropower project. Following a three-month trial, they obtained a landmark eight-figure judgment against the Province of British Columbia. The Court agreed that the denial of permits was made by the wrong people, and for improper reasons.

The matter took many years to get to trial, and Arden successfully represented the plaintiff through several pre-trial attempts by the province to have the case dismissed. Most recently, a five-judge panel of the Court of Appeal dismissed the province’s second appeal from a decision denying its application to have the claim dismissed.
